    Authentication

    We utilize Auth0 as our authentication provider to ensure your identity is verified securely and efficiently. Auth0 may require you to provide information such as your name, email address, and password. The collection and use of your data by Auth0 are subject to their privacy policy and terms.

    Subscriptions

    For subscription payments and billing, we partner with Stripe. Stripe allows for secure processing of your payment information. When you subscribe to a service, you will be asked to provide payment details to Stripe directly. Their handling of your financial data is governed by Stripe's own privacy policy and terms of service.

    OpenAI API Integration

    Our platform leverages the OpenAI API to enhance certain functionalities. By using our services, you acknowledge that some operations might be facilitated through the OpenAI API and are bound by the OpenAI use-case policies, privacy statement, and terms.

    3. No Malicious Use: The platform must not be used for any malicious purposes such as distributing malware, launching denial of service attacks, unauthorized access to systems, or any other activities intended to cause harm to individuals, businesses, or the platform itself.
    4. Data Privacy: Users must ensure that any data used or generated through the platform is managed according to privacy best practices. Sensitive information must be handled with care, and users must ensure they have the right to process such data through the AI services provided.
    5. Ethical Guidelines: Artificial Intelligence integrations must be employed ethically. Users are prohibited from using the platform to develop or disseminate AI applications that promote discrimination, hate speech, violence, or illegal activities.
    6. Resource Usage: Users should make fair use of the platform's resources, preventing unnecessary strain on the system by avoiding excessive requests or use patterns that could disrupt service performance for others.

    Users must refrain from engaging in conduct that harms the integrity, functionality, or reputation of the platform, including but not limited to:
    • Reverse engineering, decompiling, or otherwise attempting to extract the source code of the service or any related algorithm, except to the extent that this restriction is expressly prohibited by law.

    • Sharing account credentials with unauthorized parties or enabling access to the platform for individuals who have not agreed to these Terms of Service.
    • Attempting to bypass or break any security mechanisms on the platform or using the service for any penetration testing without prior authorization.
    Enforcement

    Violations of these guidelines may result in suspension or termination of your account and access to the platform. We reserve the right to investigate suspected violations of these User Conduct guidelines and take appropriate action, including reporting any illegal activity to law enforcement authorities.

    Ownership of Platform

    The software, technology, and content provided on our SaaS platform, including but not limited to the user interface, graphics, design, compilation, information, and all other elements of the service are owned or licensed by us and are protected by intellectual property laws. The arrangement and compilation of all content on this platform are the exclusive property of our company and are protected by international copyright laws.

    User-Generated Content

    Users may create, upload, post, send, receive, and store content such as code, text, photos, videos, or other materials and information on or through our platform. These data are not selled to any third-party vendor, and are stored temporarily on our servers only for technical purpose.

    Third-Party Intellectual Property

    If any applications or tools used within the platform require or include third-party software, content, service, or technology, users must comply with additional terms and conditions provided by the respective third parties.   6. Termination

    Right to Terminate

    We reserve the right to terminate or suspend your account and access to our SaaS platform at any time, without notice, for conduct that we believe violates this agreement or is harmful to other users of our services, or for our business and/or the public.

    User Initiated Termination

    You may terminate your account and subscription with our SaaS platform at any time by following the termination procedures laid out on our platform. Upon termination, your account will be closed, and you will no longer have access to our services.

    Consequences of Termination
    Upon termination of an account, whether initiated by the user or by us:
    • You will lose access to all data and content within your account.
    • We are not responsible for the loss of such data.
    • All licenses granted by us will terminate immediately.
    • Your account and its associated information, including on all third party vendors may be deleted, and it may not be recoverable.
    Subscription Cancellation

    If you cancel a subscription, you may continue to use your subscription until the end of your then-current subscription term; your subscription will not be renewed after your then-current term expires. However, you won’t be eligible for a prorated refund of any portion of the subscription fee paid for the then-current subscription period.

    Data Retention After Termination

    We may retain certain of your personal information and data after the termination of your account to the extent necessary to comply with our legal obligations, resolve disputes, enforce our agreements, support business operations, and continue to develop and improve our services. Where we retain data, we do so in accordance with any limitation periods and records retention obligations that are imposed by applicable law. This period is 1 year in France.

    Survival

    Any provision of this agreement that, by its nature, is applicable to circumstances arising after the termination of this agreement will survive termination. This includes, but is not limited to, all limitations on liability, disclaimers of warranties, disputes resolution, and intellectual property protections and licenses.

    Modification of Service

    We reserve the right to modify, suspend, or discontinue the Service, either temporarily or permanently, at any time or from time to time, with or without notice to you. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

    General Limitation

    WE SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

    Cap on Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE AGREEMENT WILL NOT EXCEED THE GREATER OF 100 DOLLARS (USD $100) OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS.

    Exclusions

    Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you. If you are a customer who is a consumer (someone who uses the services for personal reasons that are not related to their business), these provisions will apply only to the extent permitted by your local law.

    Essential Basis

    THE LIMITATIONS OF LIABILITY PROVIDED IN THESE TERMS ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN US AND YOU. THEY APPLY REGARDLESS OF WHETHER DAMAGES ARISE FROM BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER CAUSE OF ACTION, TO THE EXTENT SUCH EXCLUSIONS AND LIMITATIONS ARE NOT PROHIBITED BY APPLICABLE LAW.

    In addition to the general limitation of liability, particular services or features provided may have additional specific limitations as described within the Terms of Service related to such services or features.

  8. Governing Law

    These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Aix-en-Provence, France. In the event of any dispute or claim associated with these Terms of Service or the Service itself, the parties agree to submit to the exclusive jurisdiction and venue of the courts located in Aix-en-Provence, France.

    Notwithstanding the above, nothing in these Terms of Service will prevent us from seeking injunctive relief (or any other form of urgent legal remedy) in any jurisdiction where we believe that such action is necessary.
